Terms And Condition

DEFINITIONS
» "Applicant" means any Person(s) who is/are potential Vacationer/User who has applied for membership to the GRAND MAJESTIC HOLIDAYS.
» "ANNUAL MAINTAINENCE CHARGES" or "ANNUAL SUBCRIPTION FEES" means Charges/Fees which are decided by the GRAND MAJESTIC HOLIDAYS to be paid compulsorily by the Vacationer every year.
» “GRAND MAJESTIC HOLIDAYS” means GRAND MAJESTIC HOLIDAYS Pvt. Ltd., a company incorporated under the Companies Act, 2013.
» “GRAND MAJESTIC HOLIDAYS Tenure” means 3 / 5 / 10 / 20 years of membership.
» “Complimentary” means offers given by the GRAND MAJESTIC HOLIDAYS without any compulsion or Liability.
» “Entitlements” means 6 Night 7 days booking per year for 2 Adult & 2 Kids (below 12 year) OR 3 Adults.
» “INTERNATIONAL EXCHANGE FEES” means the fees which the vacationer has to pay to access various facilities as prescribed by the Government/Service providers of the respective nations, prior to the booking and which may vary from time to time.
» "Management" means and its directors and authorized executives.
» “Member" is a person/ first / main applicant, whose Application has been accepted by the GRAND MAJESTIC HOLIDAYS & Membership Card issued.
» “Vacationer/User” means the applicant whose application for membership has been approved by the GRAND MAJESTIC HOLIDAYS and in whose name the membership card issued.

CATEGORIES OF MEMBERSHIP
The membership to GRAND MAJESTIC HOLIDAYS is open to the following type of Individual(s).
a. Permanent Residents of India
b. Non-Resident Indian
c. Foreign Nationals, residing in or visiting India i.e. expatriate

ELIGIBILITY
a. Persons indicated in clause “Category of Membership” herein above must an adult one and offer his/her/their application for membership as per the details as given in Clause “Application Procedure” herein below.
b. No Individual member, who has been declared to be an insolvent or has been convicted by a court shall be eligible for the Golf Resort.

APPLICATION PROCEDURE
a. The application for the membership to the GRAND MAJESTIC HOLIDAYS to be made as per the prescribed format (Application Form) Original of which is torn & kept by GRAND MAJESTIC HOLIDAYS and duplicate copy given to member for record purpose that forms a part of the Membership Terms & Conditions and Applicant(s) Confirmation and declaration.
b. Applicant(s) seeking membership are required to submit the duly filled in Application Form complete in all respects and duly signed.
c. The application for the Membership needs to be submitted along with a copy of Identity, Address & Sign. Proof and other proof(s) as required by the KYC checklist and as required and decided by the management of the GRAND MAJESTIC HOLIDAYS time to time.

GRANT OF MEMBERSHIP
a. The Membership is subject to the Terms and Conditions, the Rules and Regulations made there under and as amended from time to time and as notified to the members by putting up a copy thereof at the office Premises/Website or any other suitable places of GRAND MAJESTIC HOLIDAYS under Rules and Regulations.
b. Management of the GRAND MAJESTIC HOLIDAYS has the absolute right to accept or reject any application for membership at their sole discretion without assigning any reason whatsoever and the applicant shall have no right to challenge the decision of the Management.
c. Membership is awarded only to first/ main applicant by giving membership card after proper & complete procedure is followed, as decided by management.

PAYMENT CLAUSES
a. The Vacation charges/ AMC/AMF mentioned should be paid via Cheque/DD / Credit Card / Debit Card/NEFT/RTGS/IMPS favouring “GRAND MAJESTIC HOLIDAYS PVT. LTD.” Only.
b. The Terms and Conditions include the Fee Structure for the Membership as of the date thereof as amended from time to time by the GRAND MAJESTIC HOLIDAYS. Plan & Fee Structure are forming part of this Agreement.
c. Cash Remittance – if any should be made only to “GRAND MAJESTIC HOLIDAYS” ACCOUNT DEPARTMENT and spot receipt should be obtained along with a generated mail sent to the registered e-mail address of the “Applicant(s)/ Vacationer”. The company will not be held responsible under any circumstances for cash payments to be made to company sales personnel or any other employees or marketing associates.

VACATIONERS USAGE RULES:
a. A Vacationer is entitled for 5 night and 6 days every year.
b. The accommodation shall be provided in Regular or Superior rooms subjects to availability.
c. Vacationer is entitled for accommodation of the selected time as below:
1. Either for 2 adults with 2 kids (below 12 years of age) Or 3 adults
2. A standard room can accommodate maximum of Either 3 adults Or 2 adults and 2 kids (below 12 years of age) along with one washroom only.
3. Children above12 years of age shall be considered as adult.
4. The criteria for age shall vary depending on the terms and Conditions of the respective properties at which the agreement is being made.
5. Extra bed will be provided at the rate as applicable in the allied (respective) properties.
d. Vacationer travelling with 4 adults, the charges for 1 extra person will be borne by the vacationer and in case 2 rooms are allotted to member than nights deducted will be as per multiple apartment booking.
e. All the bookings and room allocations will be subject to availability. There will be no scope of dispute regarding the same.
f. The vacationer will have right to use their nights, may also gift to blood relatives without any extra charge and to other with applicable guest fees, split the nights (2 nights minimum) with prior information to GRAND MAJESTIC HOLIDAYS as per booking terms and conditions.
g. Vacationers entitlement covers "GRAND MAJESTIC HOLIDAYS" affiliated/associated/ allies' properties which are including but not limited to short/long term lease/ tie-ups.
h. The Vacationers entitlement can be used in any of the alliance properties. The said list available on company website and will be updated from time to time.
i. The Vacationer user agrees that the vacation package is valid only when company receives the payment in full. The prices may revise from time to time without any prior notice.
j. A member has the right to use the calendar days by the GRAND MAJESTIC HOLIDAYS on the days and during the time as has been specified by the Management. The Management may further decide other category which might be notified to the member from time to time

PROCESS OF BOOKING HOLIDAYS
a. A member can avail holiday by giving by request for a reservation from the listed properties as prescribed by GRAND MAJESTIC HOLIDAYS.
b. In case of more than one applicant(s), the first/ main applicant who is membership card holder will have the right to request for booking on particular date. The booking department would revert and subject to availability would confirm the booking and the confirmation of the same would be sent to the VACATIONER user through e-mail or any other communication mode preferred.
c. All holiday Booking will be given on first come first serve basis and is open for booking as specified in clause below. Booking will be confirmed subject to availability as per GRAND MAJESTIC HOLIDAYS’s inventory allowed with the hotel/ resort.
d. Booking shall be made between 90 days to 45 days prior to the date of hotel/resort booking.
e. The Vacationer user agrees that he/she understood the booking process and aware that booking can be done either through customer care number or mail or through member Login portal on Website. f. The vacationer is liable to pay an International exchange fees for using international tie-ups. The fees may vary depending on city, country, seasons and duration of travel.
g. Any booking made cannot be cancelled. The Booking will automatically amount usage of that holiday by the vacationer. GRAND MAJESTIC HOLIDAYS has the rights to withdraw any properties from the list at any time without prior information.
i. Notwithstanding anything stated herein above, GRAND MAJESTIC HOLIDAYS shall not incur any liability if it is not in a position to fulfil its obligations by reason of any war, civil commotion, force majeure, pandemics, Act of God, other notification/s from any State Government or Government of India or the concerned countries or any order of court of law or any other reason beyond the reasonable control of GRAND MAJESTIC HOLIDAYS.

ANNUAL MAINTENANCE CHARGES (AMC)
a. The vacationer user agrees to pay Annual Maintenance Charges “AMC” of Rs.6999/- every year if availed 3 years membership and Rs.5999/- every year if availed 5/10/20 years membership together with applicable taxes or other similar taxes (if any). AMC applicable from the effective date and will be revised without prior notice. The maintenance will be payable every year before making of 1st holiday booking of the year or before completion year, whichever is earlier. The AMC is payable online and payable every year irrespective of usage of Vacationer /vacation /facilities/ amenities. Failure to clear AMC will be a breach of agreement and vacation cannot be utilised until dues are cleared. Vacationer user is also aware that failure to clear the dues “GRAND MAJESTIC HOLIDAYS” has right to terminate the Vacationer package. The Vacationer user is also aware that there is no offer or any kind whatsoever that allows for waiver for AMC .
b. AMC is non refundable and non payment of AMC would amount to breach of contract and the Vacationer would not be able to access the facilities as per the agreement any longer.
c. “GRAND MAJESTIC HOLIDAYS” reserves the right to charge additional fees including access fee or such other charges, as may be prescribed from time to time for usage of India or International properties.

GENERAL CONDITIONS
a. Withdrawal of Application and Terms of refund. The Vacation user/ member understand that the vacationer charges or membership fees and/or AMC and/or is/ are non – refundable under any circumstances and the vacationer fees/ membership fees/AMC charges is/are not a refundable deposit even irrespective of the services utilisation.
b. Transfer of membership
i. In the event of death of Vacationer applicant the entitled package can be transferred to the surviving co-applicant subject to all liabilities and obligations of the deceased and on production of death certificate of the deceased.
ii. In the event of Vacationer/user dying intestate, the entitled package will be transferred to the Nominee /legal heirs on production of death certificate and other such documents as required by “GRAND MAJESTIC HOLIDAYS” .
iii. In all cases the legal heirs/ successors to the deceased Vacationer/user shall be entitled to only the unexpired portion of the package and shall be subject to all the liabilities and obligation of the deceased Vacationer/ user.
c. The Vacationer user agrees to purchase Vacationer product of “GRAND MAJESTIC HOLIDAYS” and “GRAND MAJESTIC HOLIDAYS” accepts the same, subject to the terms and condition of this agreement.
d. The Vacationer /user understood the benefits available under these products which are more particularly listed out in this agreement. The Vacationer/ user further understands that no benefits other than these listed in this agreement will be available to the Vacationer/ user.
e. The Vacationer user understands that Pick up -drop/sightseeing/ flights/ break -fast/lunch/dinner/hi-tea/brunch is not a part of his/ her Vacationer product. It can be arranged only at an additional charge depending on resorts/place/country and “GRAND MAJESTIC HOLIDAYS” has no responsibility for such services.
f. The Vacationer user understands that he/she are bounded by Rules and Regulations of “GRAND MAJESTIC HOLIDAYS” as duly amended from time to time. The decision of the management of “GRAND MAJESTIC HOLIDAYS” would be final in all Matters.
g. Apart from these terms and conditions, all other statues as applicable shall be binding on Vacationer/ users.
h. The Vacationer user understands that this agreement SUPERSEDES including but not limited to any communication whether written or local or any other written communication issued by “GRAND MAJESTIC HOLIDAYS representative including on company letterhead and stamped.
i. The Vacationer user agrees that he/she have gone through terms and conditions and benefits/obligations and have understood and accepted the same.
j. The correspondence from “GRAND MAJESTIC HOLIDAYS” shall be addressed to the first named applicant only.

TAXES
A Vacationer user shall be liable to pay all taxes/charges/levies statutory or otherwise imposed by or payable to any government or local body or any other authority on Vacationer price/ AMC or any other charges arising out of purchase /use of “GRAND MAJESTIC HOLIDAYS” membership. Non-payment of taxes and levies shall disentitle the Vacationer user from enjoying vacations and shall amount to breach of contract and result in termination of Vacationer agreement.

INDEMNIFICATIONS
The Vacationer user agrees to indemnify, defend and hold harmless from all claims, disputes, litigations, judgements, all costs and attorney fees resulting from (a) loss, damage or injury to the user and user family, guests or their personal property. (b) any acts or omissions of the Vacationer/ user (c) the booking of or travel in connection with a “GRAND MAJESTIC HOLIDAYS” package (d) the acts, omissions, products, or services of any travel suppliers person or company rendering services in connection with “GRAND MAJESTIC HOLIDAYS” (e) any failure or delay or performance by any travel supplier. “GRAND MAJESTIC HOLIDAYS” not responsibility for lost, stolen or misplaced items. Vacationer/ user also aware of the inherent risks to person and property while occupying residences near the ocean or that have pool/ Jacuzzi features.

ARBITRATION
In the event of any difficulty, the Vacationer/user must First contact the call centre team of “GRAND MAJESTIC HOLIDAYS”. In the event, the Vacationer/User is not satisfied, the Vacationer/User shall discuss the issue with the Dispute Resolution Cell of the “GRAND MAJESTIC HOLIDAYS” at BHOPAL. Even thereafter, if the parties fail to reach any amicable solution, all or any dispute and difference/s which may arise between the parties out of or in relation to this terms and conditions, shall be finally settled by arbitration in BHOPAL by an arbitrator Shri H. M. Sheth, hereby mutually appointed by the Member/ Vacationer/user and the company under Arbitration and conciliation Act,1996. In no case vacationer/user and the company is allow to go directly in Police/Courts for filing complain without opting arbitration procedure.

The parties further agree that the award of the arbitrator is binding upon the parties and that judgement upon the award rendered may be entered in the Court of BHOPAL jurisdiction only.

JURISDICTION AND APPLICABLE LAW
This services rendered hereunder are subject to all the applicable laws and regulation of India and the Courts of Law, BHOPAL City only shall have exclusive jurisdiction and there will be exclusion of all other courts to try and decide dispute, if any kind between the parties hereto.
